Cliff was the caregiver for Marita and Johnny, who are both disabled. The Ministry of Health had appealed against earlier Human Rights Review Tribunal and High Court decisions that it was discriminatory for the ministry not to pay family members looking after disabled relatives. The Court of Appeal upheld the decisions of the tribunal and High Court. These decisions were made under legislation designed to provide better protection of human rights, as agreed to under various United Nations conventions signed by New Zealand.
